In Illinois, there are two definitions of reckless driving. A driver commits reckless driving in two ways:

  1. When he or she drives any vehicle with a willful or wanton disregard for the safety of persons or property; or
  2. knowingly drives a vehicle and uses an incline in the roadway, such as a railroad crossing, bridge approach, or a hill, to cause the vehicle to become airborne.

The second definition is more objective and therefore easier to prove in court, but the first has a very broad definition that is difficult for the average layperson to interpret, which it’s why it’s so important to obtain the expertise of an experienced attorney before appearing in court for such a charge.

The important words in the first part of the law are “willful” and “wanton.” What those terms mean is that the driver of the vehicle knowingly and purposely drove the vehicle in an unsafe manner.

It’s important to remember that prosecutors don’t need to prove intent. They don’t need to prove that you intended your operation of the vehicle to be reckless, simply that it was.

Usually, speeding alone is not enough to draw a conviction for reckless driving — generally, reckless driving charges are brought when an accident occurs, or when the offender is seen weaving in and out of traffic.
